TERMS AND CONDITIONS OF TRADING
In these Terms and Conditions ‘Premier Carpets & Flooring Ltd’ is referred to as ‘the Company’, ‘Us’, ‘We’ and ‘Our’. ‘You’ and ‘Your’ refers to ‘the Customer’ who is buying the goods or service.
Website & Catalogue Terms of Use
You are not allowed to copy any images or information from our website other than for your own use. If you do copy anything it must not be changed and redistributed. You must not use the content of our website to conduct activities that breach any laws or infringe any third party’s rights.
The website is as accurate as we can make it; the Company cannot accept any liability if there are any errors on the website. We reserve the right to make changes at any time.
Pricing & Stock
The Company endeavours to ensure all prices are as accurate as possible. The correct price for any product is that displayed on the website at the time and date of your order. If we make a mistake on price and you are charged more than the normal price then we will refund the difference.
All orders are priced in £ sterling, and this is the only currency accepted.
If an item is on sale then the ‘was’ price will be the highest price it has been in the previous 12 months, and it will have been at that price for at least 28 consecutive days.
We try to ensure stock levels are accurate, but cannot be held liable if there is insufficient stock to dispatch an order. If a non-sale item is out of stock then we will bring it back into stock as quickly as we are able to.
Items on sale might run out at any time. Once we have run out of stock of a sale item we will not be able to accept any orders for the product.
Price Match Guarantee
Premier Carpets & Flooring Ltd strive to offer customers the best service and products at competitive prices. In order to uphold our Price Match Guarantee, we monitor prices offered by our competitors and adjust pricing if necessary. If you find a cheaper price we'll match it. Terms & Conditions include: Items must be identical. Items must be in stock. The price must be publicly advertised online. We cannot match sale or promotional prices. The competitor must be based in the UK and sell direct to customers (no auction or marketplace retailers). No other promotional offers or vouchers can be used on top of a price match.
Ordering & Payment
The Company reserves the right to refuse or accept any order. Placing of an order implies the acceptance of these terms of trading.
Orders for products from our online shop are only accepted when we dispatch them. We might not be able to accept your order if:

When paying by credit or debit card your funds do not clear

We have made a pricing or product description error

A product is out of stock, is not available, or is a sale item that has sold out

You are using our website in a manner we believe to be irresponsible
Our right to refuse an order might be exercised, for example, if we believe the card being used for an order has been stolen.
For fitting and installation projects the Company will invoice the purchaser for goods and services purchased upon completion of any project. Payment is due immediately upon completion of any project. Time for payment shall be of the essence of the contract.
If the Customer fails to pay on the due date, the Company shall be entitled to:

the immediate payment of all outstanding payments of any goods, services or works under the contract even if the payment is not due and irrespective of any credit facilities and;

charge the purchaser interest at the rate of 4% per annum above the base rate of HSBC Bank Plc (subject to a minimum rate of 12%) on the amount outstanding calculated on a daily basis from the date when payment is due until the date when payment is received by the Company and;
-
charge the purchaser the cost of recovery of any unpaid amount including any legal costs, disbursements and bank charges incurred.
Value Added Tax
For orders requiring a fitting service our prices quoted do not include Value Added Tax which will be charged at the applicable rate at the date of supply of labour and/or materials.
Delivery
Depending upon when the order is received and our stock levels, we will normally dispatch orders within 1-3 working days.
Once dispatched delivery to mainland UK is normally next working day, but could be 2-3 working days for islands, Scottish highlands or for Northern Ireland.
Orders can only be accepted and dispatched to the United Kingdom. No orders will be accepted for export.
Cancellations
Cancellations of an order for fitting cannot be accepted by telephone unless confirmed in writing without delay. Cancellations of an order for product from our online shop can be accepted as long as the order has not been shipped.
Returns
If you want to return an item please call our contact centre within 14 days (for all contact details please see our contact us page). If you are returning a product because it is faulty or something is wrong then we will pay for the return of the items and will normally arrange for them to be collected from you. If you are returning a product because you have changed your mind then you will normally have to pay for the return including any restocking charges.
Faulty items will be replaced if stock is available or will be refunded. If your order is considered a bespoke order (i.e. if the length is smaller than the width, or the vinyl is cut into a specific length), then we cannot accept a cancellation of contract. As the product was made for you specifically, your statutory rights by law to cancel do not apply.

Insolvency of Purchaser
This clause applies only to orders where a fitting or installation service has been engaged.
This clause applies if the Customer:

Makes any voluntary arrangement with its creditors or (being individual or firm) becomes bankrupt or (being a company) becomes subject to an administration order or goes into liquidation (otherwise than for the purposes of amalgamation or reconstruction) or
-
An encumbrancer takes possession, or a receiver is appointed, of any of the property or assets of the purchase or
-
The purchaser ceases, or threatens to cease, to carry on business or
-
The Company reasonably apprehends that any of the events mentioned above is about to occur in relation to the purchaser and notifies the purchaser accordingly.
If this clause applies then, without prejudice to any other right or remedy to the Company, the Company shall be entitled to cancel the contract without any liability to the Customer and if the goods or service have been delivered but not paid for the price shall become immediately due and payable notwithstanding any previous agreement or arrangement to the contrary.
Retention of Title
So long as any money owing to the Company from the Customer is outstanding in respect of any goods sold subject to these terms and conditions, the title to such goods or services delivered by the Company to you will not pass but shall remain with the Company until all such indebtedness has been discharged.
The Company may itself, or by its servants and agents (and without prejudice to any other rights) enter upon your premises and recover the goods.
Conditions
You agree not to infringe the copyright of our websites or any other intellectual property (for example by copying and reusing images).
Our websites are produced as accurately as possible, but to the fullest extent permitted by the law we make no representations, warranties (express or implied) with respect to the content.
We exclude to the fullest extent permissible by law any and all liability howsoever arising for any faults, inaccuracies or omissions relating to our websites and the unavailability of our website.
No director, employee or representative will be liable whether in contract, tort, negligence or otherwise, for any loss or damage whether direct or indirect arising out of or in connection with your use of our websites, including, without limitation, damage to software or hardware, economic loss, loss of data, consequential damage, loss of or damage to property and claims of third parties.
None of these exclusions and limitations are intended to limit any rights you have as a customer, or any statutory rights which may not be excluded, nor in any way to exclude or limit our liability to you for death or personal injury resulting from our negligence or that of our agents, representatives or employees.
Each of the above exclusions and/or limitations shall be construed as a separate and severable provision of these terms.
If any court holds any provision of these terms to be void or unenforceable, it shall be deleted and the remaining provisions shall continue in full force and effect.
These terms shall be governed by and construed in accordance with the laws of England and Wales, and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
